Article 29-30: Foundation of the Most Important Cultural and Educational Rights of Minorities

Cultural and Educational Rights is a Fundamental Right, which is enshrined in Part III of the Indian Constitution. Articles 29-30 deals with the provisions of the Cultural and Educational Rights.

Two most important cultural and educational rights is:

Protection of Interests of Minorities (Article 29)

  • Any citizen, living in any part of the country, having a distinct language, script or culture of its own, shall have the right to conserve it
  • No citizen shall be denied admission into an educational institution which is either maintained by the state or receiving aid out of state funds, on grounds of religion, race, caste, or language
  • This article grants protection to both religious and linguistic minorities

Right of Minorities to Establish and Administer Educational Institutions (Article 30)

  • Minorities can establish and administer educational institution of their choice
  • According to the 44th Amendment Act of 1978, the compensation amount which is fixed by the state for the acquisition of any property of a minority educational institution, will not restrict the right guaranteed to them
  • In matters of granting aid, states will not discriminate against any minority educational institution
  • This article is confined only to minorities
